An important decision of the Supreme Court of Nigeria, which finally established the right of states to regulate and license lotteries, opened up completely new perspectives for the gambling market. After more than a decade of legal battles between federal and regional authorities, the case was decided in favor of local regulators.
The history of the conflict
It all started back in 2007 when the Lagos State Lottery Board (LSLB) and the National Lottery Regulatory Commission (NLRC) clashed over who had the authority to issue lottery licenses. The NLRC, relying on the federal law, argued that lotteries fall exclusively under its jurisdiction.
The conflict turned into litigation, which slowed down the development of the market and created legal uncertainty for gambling operators.
After numerous appeals hearings, the Supreme Court issued a final ruling that officially confirmed the right of states to regulate and license lotteries, finally removing the national regulator’s claims of monopoly in this area and formulating a new model of relations between the federal and state governments.
This decision opens up the prospects of significant expansion for the Nigerian iGaming market.
Firstly, operators can obtain licenses directly from the authorities of a particular state, avoiding protracted bureaucratic procedures at the level of central authorities.
Secondly, different states are motivated to introduce attractive conditions for attracting investments, which in turn means a reduction in the tax burden for operators, simplification of license obtainment, and reduction of gambling regulation in certain aspects.
Thirdly, a clear regulatory framework allows to legally reach local consumers in certain states, offering a wider range of gambling products and services for a more specific audience.
Thus, companies will be able to plan their strategies more efficiently, expanding their presence across the country, taking into account the specifics of each region.
