In short
- Cyprus counts days and ties. Citizenship and a green card are not part of the test.
- The €80 certificate is issued because Cyprus has a treaty with the United States, in force since 1985.
- A resident who is not domiciled in Cyprus pays no Special Defence Contribution on dividends or interest.
- US tax, FBAR and Form 8938 are for your US adviser. This guide covers the Cyprus side only.

Does a US citizen become Cyprus tax resident, and what decides it?
Yes, and the Tax Department decides it from your calendar. Its page lists two criteria, the 183-day rule and the 60-day rule of Article 2 of the Income Tax Law. Citizenship, a visa and a green card are not among them, so every nationality gets the same answer for the same year. Cyprus tax residency: the 183-day and 60-day rules sets out both rules. This guide applies them to a year shared between Cyprus and the United States.
| Your year | Days: Cyprus / US / elsewhere | Ties in Cyprus | Result in Cyprus |
|---|---|---|---|
| Lives in Cyprus most of the year | 190 / 175 / 0 | None needed | Yes, 183-day rule |
| Splits the year, keeps a lease and a directorship | 70 / 180 / 115 | Home and office kept to 31 December | Yes, 60-day rule |
| Same split, 200 days in the United States | 70 / 200 / 95 | Home and office kept to 31 December | No, US days pass 183 |
| Long visits, home base in the United States | 150 / 215 / 0 | Home and office | No, Cyprus days do not pass 183 and US days do |
Each row adds up to 365 days. A resident pays Cyprus tax on income from Cyprus and from abroad, a non-resident on income from Cyprus alone. Our tax services in Cyprus file the returns of a Cyprus company, the usual way to create the office or job that the 60-day rule asks for. Opening a Cyprus company from abroad explains the steps.
The 60-day rule when your other home is in the United States
One condition of the 60-day rule concerns the United States: no more than 183 days in any other single country in the tax year. An American who also works or keeps a home there counts those days first. The other three are 60 days or more in Cyprus, a permanent home there, owned or rented, and a Cyprus business, job or office kept to 31 December.
Since 1 January 2026 the rule no longer asks that no other country treats you as its tax resident. The Tax Department's presentation of 11 May 2026 says the condition was deleted, and that the job in Cyprus need not be with a Cypriot employer. It does not say how a remote worker is treated whose contract and payroll stay with a US employer. Settle that case before you rely on the rule, or hold a tie the page names without doubt, such as a business in Cyprus or an office in a Cyprus tax-resident company.
| Condition | What the Tax Department asks you to show |
|---|---|
| A permanent home in Cyprus | A title deed, a stamped contract of sale or a stamped tenancy agreement. The certificate adds a utility bill from the last six months |
| A job in Cyprus | The employer's letter with the terms, a stamped employment contract, or the hiring notice filed in Ergani with the status Submitted, and your social insurance number |
| A business or an office in Cyprus | A letter that explains why you register, with the papers behind the reason |
| 60 days in Cyprus, 183 at most in the United States | The Department names no day-count document. Boarding passes and passport stamps for every trip are your record |
Registering in Cyprus as a US citizen, step by step
A US citizen is a third-country national for the Tax Registry, which sorts applicants by the document they hold.
- Create an account on Tax For All, the Tax Department's portal, the only channel for registration. You can log in through CY Login, the state's sign-in.
- Choose Register as a new taxpayer. A holder of a Cyprus residence permit uploads all sides of it. A person who has applied for the permit uploads the proof of payment.
- A person who holds neither uploads a third-country tax identification number certificate, identity card or social insurance number certificate.
- Add a recent photograph and a letter that explains why you register, with the papers behind it.
- Under the 60-day rule add the title deed or stamped tenancy agreement of your home. An employee adds the employer's letter, a stamped contract or the Ergani notice, and states the social insurance number.
- Answer any request for further papers.
A tax resident registers on any gross income from Cyprus or abroad, and every resident aged 25 to 70 registers and files a return even with no income.
If you also plan to own the company yourself, the Cyprus side of that step is in the guide for US citizens who form a Cyprus company.
Residence permit routes for a US citizen in one paragraph
Tax residence and the right to live in Cyprus are separate, and a permit does not make you tax resident: your days do. A US citizen needs a permit from the Migration Department for a stay beyond a visit. Category F asks a secured income from abroad of €9,568 a year for the applicant and €4,613 for each dependant, with no business in Cyprus. The digital nomad visa asks €3,500 net a month, lasts one year and renews for up to two more. Permanent residence by investment asks €300,000 invested and €50,000 of annual income. The page on residence permits in Cyprus compares them.
Non-dom status for someone who has lived in the United States
Non-dom status turns on domicile, which differs from residence. The Tax Department starts from your domicile of origin, taken at birth and usually the father's domicile on that day. A person whose origin lies outside Cyprus is not domiciled there, and a resident who is not domiciled pays no Special Defence Contribution (SDC) on dividends and interest.
| Your case | Domicile in Cyprus | Forms |
|---|---|---|
| Domicile of origin outside Cyprus | No, until the 17th resident year of the last 20 | T.D.38 with questionnaire T.D.38QA |
| Cyprus domicile of origin, a life in the United States | No, if you hold a domicile of choice outside Cyprus and were not tax resident in Cyprus for 20 consecutive years right before the tax year | T.D.38 with T.D.38QA and T.D.38QB |
| Any origin, tax resident in Cyprus in 17 of the last 20 years | Yes, deemed domiciled | T.D.631 for the paid extension |
A person without a Cyprus domicile of origin can extend the exemption twice, for €250,000 in each period of five years. The exemption removes one tax: a resident still declares income from Cyprus and from abroad and pays 2.65% to GeSY, the health system, on dividends and interest. Form T.D.624/NP, given to each payer in Cyprus, stops it withholding SDC. The guide to Cyprus non-dom rules counts the 17 years, and non-dom status in Cyprus is the service in which we register it.

The Cyprus-US double tax treaty: what exists and what Cyprus does with it
Cyprus and the United States have a treaty to avoid double taxation. The Ministry of Finance's list gives 19 March 1984 as the date of signature and 31 December 1985 as the date of entry into force and carries the English text.
Two things follow on the Cyprus side. The Tax Department issues a certificate of tax residence only where a treaty exists, and the United States is on the Ministry's list. Article 35 of the Income Tax Law gives a credit against Cyprus tax for tax paid abroad where the treaty provides for one. The credit cannot exceed the Cyprus tax on that income or your total Cyprus tax for the year. You claim it within six years of the end of the tax year. How the treaty applies to a US citizen depends on its articles and on US law, so give your US adviser the treaty text.
What the Cyprus authorities can issue to you, and what they cannot
| Document or decision | Who issues it | What it is for |
|---|---|---|
| Tax identification number | Tax Department, through Tax For All | Registers you in the Cyprus Tax Registry, so that you can file |
| Certificate of tax residence, form T.D.126, €80 in fee stamps | Tax Department, district office | Shows that you are tax resident in Cyprus, for use in a country that has a treaty with Cyprus |
| Decision on the SDC exemption, form T.D.38 | Tax Department, district office | Treats you as not domiciled in Cyprus for SDC |
The certificate speaks of your residence in Cyprus and says nothing about your position in the United States, which is for the IRS. The Department issues none where no treaty exists, and it does not replace a permit. A residency form that a foreign authority gives you is stamped by the same procedure and fee, and the foreign part stays with that authority.
You send form T.D.126 and the papers the page lists to the district office by email or post, and an officer calls you to pay the fee stamp at the cash counter. Circular 2017/08 of 10 March 2017 deals with a certificate issued in the same tax year, so you can ask once your days are met, or after the year ends.
Your first Cyprus tax return and what you pay
The deadline in law is 31 July of the following year. It was moved to 31 October 2026 for tax year 2025, and the Tax Department gives 31 July 2027 for tax year 2026. From tax year 2026 the return is filed only on Tax For All. The paper return, form T.D.1, is for a person whom the Department asks to use it.
The bands of 2026 are 0% up to €22,000 of taxable income, 20% to €32,000, 25% to €42,000, 30% to €72,000 and 35% above. Take a salary of €60,000 with no allowances taken off. The tax is €9,900: nothing on the first €22,000, then €2,000 at 20%, €2,500 at 25% and €5,400 at 30%. GeSY adds 2.65% of the salary, €1,590. These are Cyprus figures only. An employee gives the employer form T.D.59A, the 2026 declaration for claiming deductions, and the employer withholds tax monthly on it.
We register you, count your days, apply for the certificate and file the return. The Cyprus company that carries your office or job is covered by our tax services in Cyprus.
What we do not advise: the United States side
We advise on the Cyprus side only. Whether you owe US tax after you move is for a US tax adviser who has your return in front of them. That covers US taxation by citizenship, the saving clause of a treaty, the foreign earned income exclusion and the foreign tax credit. It covers the FBAR, Form 8938 and any other US reporting or entity classification. Nothing in this guide promises a US result.
The IRS page for U.S. citizens and resident aliens abroad and Publication 901 on U.S. tax treaties are listed under the sources. We opened them and do not interpret them.
